This end user license agreement governs your use of the TreyTech Client App. By tapping Agree and continue, booking a creative consult, or engaging our services through the app, you agree to these terms.

This is the same agreement shown inside the app (Account → License agreement). Where a signed proposal, statement of work, master services agreement, or non-disclosure agreement exists for your engagement, that document controls if it conflicts with these terms. Our website Terms & Conditions and Privacy Policy also apply.

01Acceptance of these termsAPPLE EULA §1

These terms govern your access to and use of the TreyTech Client App, a product of TreyTech Studios, LLC, d/b/a TreyTech ("TreyTech," "we," "us," or "our"). By tapping Agree and continue, booking a creative consult, or engaging our services through the app, you agree to these terms. This agreement is concluded between you and TreyTech only. It is not with Apple Inc. TreyTech, not Apple, is solely responsible for the app and its content, and these terms will never set usage rules that conflict with the Apple Media Services Terms and Conditions, which you have had the chance to review. Where a signed proposal, statement of work, master services agreement, or non-disclosure agreement exists for your engagement, that document controls if it conflicts with these terms.

02Your license to use the appAPPLE EULA §2

We grant you a personal, non-transferable license to use the app on any Apple-branded products you own or control, under the Usage Rules in the Apple Media Services Terms and Conditions. Accounts linked to yours through Family Sharing or volume purchasing may also use it. The license does not transfer with a sale of your device.

03How engagements work

Every engagement begins with a creative consult, and the path is right-sized to the work. Individuals and simple builds get a consult, then a clear quote you approve, then we build. Business and enterprise engagements add discovery and the right agreement for the scope, with a mutual non-disclosure agreement when sensitive information is involved. You work with a single Engagement Manager as your point of contact. No production work begins before the applicable quote or agreement is approved.

04Fees and payment

The creative consult is a non-refundable fee covering the strategy session and the planning that follows. Project work is delivered on a fixed fee per project, scaled to the scope and agreed before work begins. No hourly creep and no surprise invoices. Ongoing relationships may be offered on a monthly or annual subscription. In-app payments and subscriptions are processed through the App Store using Apple in-app purchase and StoreKit, and you manage or cancel any subscription in your Apple account settings. Late or missed payments may pause or suspend work.

05Intellectual propertyAPPLE EULA §6

TreyTech, our network members, and our collaborators retain their own pre-existing tools, methods, know-how, templates, and portfolio rights. TreyTech brand assets, the studio framework, and our marks remain our property. For business and enterprise clients, any client intellectual property, proprietary materials, and confidential business information remain the property of the client, are treated as confidential, and are governed by your signed agreement. If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, TreyTech, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.

06The Studio Pros and Creative Network

Our Founding and Creative Network is made up of vetted independent professionals. Applying does not guarantee acceptance or work. Network members are independent contractors, not employees, and are engaged on a project basis at a fixed fee agreed before work begins. Members are responsible for their own taxes, equipment, and compliance. Confidentiality, IP assignment for specific client deliverables, and conduct expectations are set per project.

07Confidentiality and data

Business and enterprise client intellectual property and confidential information, and the personal and professional data of our creators and network members, are treated as confidential and are subject to the applicable signed agreement. We use such information only to deliver the engagement, limit access to the people who need it, and do not sell it. Absent a signed agreement, do not share information you consider confidential through public forms, channels, or community spaces, as we cannot guarantee confidentiality outside of a signed agreement.

08Third-party tools and platformsAPPLE EULA §9

The app brings your consult, contract, payment, and project work together behind one session, and some steps rely on third-party services, including scheduling, embedded video conferencing for your consult, e-signature for contracts, and payment and subscription billing. Your use of those services is subject to their own terms, and you must also comply with your own wireless data service agreement. We are not responsible for third-party platforms, outages, or changes. AI-assisted work is reviewed by real people, and we are responsible for the quality of what we deliver.

09Maintenance and supportAPPLE EULA §3

TreyTech alone is responsible for maintenance and support of the app, as described here or as required by law. Reach us at info@treytech.biz or (945) 393-5679. You and TreyTech acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support for the app.

10Warranties and disclaimersAPPLE EULA §4

We deliver professional, high-quality work and stand behind it. That said, except as expressly stated in a signed agreement, the app and services are provided AS IS without warranties of any kind, and we do not guarantee specific business, revenue, ranking, or performance outcomes. TreyTech is solely responsible for any warranties that are not effectively disclaimed. If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, to you. To the maximum extent allowed by law, Apple has no other warranty obligation, and any other claims tied to a warranty failure are TreyTech's sole responsibility.

11Product claims and liabilityAPPLE EULA §5

TreyTech, not Apple, is responsible for addressing any claim from you or a third party about the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws. To the maximum extent permitted by law, TreyTech and its network are not liable for indirect, incidental, or consequential damages, and our total liability for any engagement is limited to the amount you paid TreyTech. This agreement does not limit our liability to you beyond what the law permits.

12Legal, governing law, and exportAPPLE EULA §7

These terms are governed by the laws of the State of Texas, without regard to conflict of laws rules, and disputes are handled in the state or federal courts in the Dallas-Fort Worth area unless your signed agreement says otherwise. You also represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

13Termination

Either party may end an engagement as set out in the applicable agreement. Fees for work performed and non-refundable amounts remain due. We may suspend or end access to the app, community, or services for conduct that violates these terms. Sections that by their nature should survive, including intellectual property, warranty, liability, and the Apple provisions, survive termination.

14Changes to these terms

We may update these terms from time to time. The effective date reflects the current version. Continued use of the app after an update means you accept the revised terms.

15Apple as third-party beneficiaryAPPLE EULA §10

You and TreyTech acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance of these terms, Apple gains the right, and is deemed to have accepted the right, to enforce this agreement against you as a third-party beneficiary.
