This end user license agreement governs your use of the TreyTech Client App. By tapping Agree and continue, booking a creative consult, or engaging our services through the app, you agree to these terms.

This is the same agreement shown inside the app (Account → License agreement). Where a signed proposal, statement of work, master services agreement, or non-disclosure agreement exists for your engagement, that document controls if it conflicts with these terms. 01Acceptance of these termsAPPLE EULA §1

These terms govern your access to and use of the TreyTech Client App, a product of TreyTech Studios, LLC, d/b/a TreyTech ("TreyTech," "we," "us," or "our"). By tapping Agree and continue, booking a creative consult, or engaging our services through the app, you agree to these terms. This agreement is concluded between you and TreyTech only, not with Apple Inc. TreyTech, not Apple, is solely responsible for the app and its content, and these terms will never set usage rules that conflict with the Apple Media Services Terms and Conditions. Where a signed proposal, statement of work, master services agreement, or nondisclosure agreement governs a particular engagement, that agreement will control solely with respect to the applicable services and engagement if it conflicts with these terms. However, no separate agreement will modify, supersede, or conflict with the provisions of these terms required by Apple’s Minimum Terms of Developer’s End-User License Agreement or the applicable Usage Rules.

02Your license to use the appAPPLE EULA §2

We grant you a personal, non-transferable license to use the app on any Apple-branded products you own or control, in accordance with the Usage Rules in the Apple Media Services Terms and Conditions. Accounts linked to yours through Family Sharing or volume purchasing may also use it. The license does not transfer with the sale of your device.

03How engagements work

Every engagement begins with a creative consult, tailored to the scope of the work. Individuals and simple builds: consult, then a clear quote you approve, then we build. Business and enterprise: consult, discovery phase, appropriate agreement, and an NDA if needed. A single Engagement Manager is your point of contact. No production work begins before the applicable quote or agreement is approved.

04Fees and payment

The creative consult is a non-refundable fee covering the strategy session and planning. Project work is delivered on a fixed-fee-per-project basis, scaled to the scope and agreed before work begins. No hourly creep or surprise invoices. Ongoing relationships may be offered on monthly or annual subscriptions. In-app payments and subscriptions are processed through the App Store via Apple in-app purchase and StoreKit; you manage or cancel subscriptions in your Apple account settings. Late or missed payments may pause or suspend work.

05Intellectual propertyAPPLE EULA §6

TreyTech, our network members, and collaborators retain all pre-existing tools, methods, know-how, templates, and portfolio rights. TreyTech brand assets, the studio framework, and our marks remain our property. Business and enterprise client intellectual property and confidential materials remain the property of the client and are governed by your signed agreement. If a third party claims that the app or your use of it infringes their intellectual property rights, TreyTech, not Apple, is solely responsible for resolving that claim.

06The Studio Pros and Creative Network

Our vetted Founding and Creative Network consists of independent professionals. Applying does not guarantee acceptance or work. Network members are independent contractors, not employees. They are engaged per project at a pre-agreed fixed fee and are responsible for their own taxes, equipment, and compliance. Confidentiality, IP assignment for client deliverables, and conduct expectations are set per project.

07Confidentiality and data

Business and enterprise client IP and confidential information, plus the personal and professional data of our creators and network members, are treated as confidential and subject to the applicable signed agreement. We use such information only to deliver the engagement, limit access to necessary personnel, and do not sell it. Without a signed agreement, do not share sensitive information in public channels or community spaces.

08Third-party tools and platformsAPPLE EULA §9

The app integrates consults, contracts, payments, and project work, with some steps relying on third-party services (scheduling, embedded video conferencing, e-signatures, payment and subscription billing). Your use of these services is subject to their own terms, and you must comply with your wireless data agreement. We are not responsible for third-party platform outages or changes. AI-assisted work is reviewed by humans, and we remain responsible for quality.

09Maintenance and supportAPPLE EULA §3

TreyTech is solely responsible for app maintenance and support. Contact: support@treytech.biz or (945) 393-5679. Apple has no obligation to provide maintenance or support.

10Warranties and disclaimersAPPLE EULA §4

We deliver professional, high-quality work but, unless expressly stated in a signed agreement, the app and services are provided AS IS, without warranties of any kind. TreyTech is solely responsible for all product warranties, whether express or implied by law, to the extent such warranties have not been effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, paid for the app. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure of the app to conform to an applicable warranty are TreyTech’s sole responsibility.

11Product claims and liabilityAPPLE EULA §5

You and TreyTech acknowledge that TreyTech, not Apple, is responsible for addressing any claim by you or any third party relating to the app or your possession or use of the app, including: (a) product-liability claims; (b) claims that the app fails to conform to an applicable legal or regulatory requirement; and (c) claims arising under consumer-protection, privacy, or similar legislation, including any claims connected with the app’s use of the HealthKit or HomeKit frameworks, if applicable. This agreement does not limit our liability where prohibited by law.

12Legal, governing law, and exportAPPLE EULA §7

These terms are governed by Texas law, with disputes handled in Dallas-Fort Worth state or federal courts unless your signed agreement provides otherwise. You represent that you are not located in a U.S.-embargoed or designated terrorist-supporting country and are not listed on any U.S. Government prohibited or restricted party list.

13Termination

Either party may terminate an engagement in accordance with the applicable agreement. Fees for work performed and non-refundable amounts remain due. We may suspend or terminate app, community, or services access for violations of these terms. Sections related to intellectual property, warranty, liability, and Apple provisions survive termination.

14Changes to these terms

We may update these terms periodically. The effective date reflects the current version. If a change is material, we will provide notice through the app, by email, or by another reasonable method before the change becomes effective. Where required by applicable law, we will obtain your affirmative acceptance of the revised terms. Changes will not apply retroactively unless permitted by law. Your continued use of the app after properly notified revised terms become effective constitutes acceptance of those revised terms. Related: Terms of Service, Privacy Policy, and TreyTech for iOS.

15Apple as third-party beneficiaryAPPLE EULA §10

You and TreyTech acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance of these terms, Apple gains the right, and is deemed to have accepted the right, to enforce this agreement against you as a third-party beneficiary.
